An 10-month-old baby girl in Brooklyn died from an overdose of fentanyl and heroin after her 44-year-old father, Daniel Auster, son of renowned author Paul Auster, died in childbirth be accused.

Police said the baby girl, named Ruby Auster , was found unconscious on Nov. 1 at her home on Burjian Street in Throop, Brooklyn, and was pronounced dead at a Brooklyn hospital. The medical examiner's office later pronounced death a result of drug overdose (Overdose, OD).

Oster, 44, was summoned to appear in court on April 10 for criminal conduct of homicide, negligent death and endangering the welfare of a child, according to the court's criminal proceedings. The judge set the bail at $100,000 in cash, or $250,000 in bail, and ordered him to appear at a court hearing on the 21st, when it will decide whether there is enough criminal evidence to continue the case.

Mr Oster's legal defender, Legal Aid Community lawyer John Godfrey, said none of his clients had been drinking recently and had been on drug treatment. Godfrey said Mr Oster, who works in gardening, turned himself in to police on his own initiative.

"This case is a painful tragedy, and Mr. Oster is still deeply devastated by the death of his dear daughter Ruby," Goldfrey said. "Medication problems plague countless families every year. We hope that at this difficult time for this family, the public will be cautious, not criticizing, and respecting the privacy of this family."

Ruby's mother, Zuzan Smith, wife of Mr Oster, told police the baby girl was awake and appeared to be in normal condition before she left the house that morning, court documents said. Mr Oster told police he had injected heroin after his wife went out, then lay down next to his daughter in his bed for a nap, and when he opened his eyes, the baby girl was blue-skinned and unresponsive or had any signs of life.

The documents show that Mr. Oster immediately administered the OD's life-saving drug " Narcan " to the baby girl and tried to wake the baby up before calling 911 for help. After the results of the toxicity tests, the medical examiner declared the baby girl was murdered, but court documents did not say how the baby ingested the drugs. Auster was arrested on the 8th.

Outside the home on Osterborjian Street, two neighbors said on the 16th that when they usually touched the little baby girl, Mr. Oster and his partner were very friendly, but one day last fall, the neighbor saw the girl. The baby's belongings, such as clothes, children's books and toys, were scattered on the sidewalk outside Oster's house before neighbors learned that the baby girl was dead.

The medical examiner's office declined to comment, citing an ongoing investigation.

In 1996, Daniel Auster was involved in a hideous nighttime murder in which nightclub owner Michael Alig and an accomplice murdered and dismembered drug dealer Andrew Melendez , nicknamed 'Angel', and then Throw his body into the Hudson River. Auster received a suspended sentence after admitting in 1998 that he was in possession of $3,000 he stole from Melendez.
