A country full of "malicious"

Recently, three incidents in the mainland have been circulating on the Internet. First, the Canon Zhuhai factory, which had been in operation for 32 years, closed its doors. The severance pay for the 1,317 employees far exceeded the national standard.


Some people regard it as "malicious compensation" because it compares the severance behavior of some state-owned enterprises and private enterprises with shame; (we also introduced an article yesterday, and some people even doubt the authenticity of the incident) (relevant documents are attached)


The second is the remarks made by county magistrate Dong of Dancheng County, Zhoukou City, Henan Province on epidemic prevention. He said, "Anyone who tries to return from a medium or high risk area, no matter whether you have a vaccination certificate or not, whether you have a 48-hour nucleic acid test or not, as long as you don't listen to the dissuasion. , returned to the hometown maliciously, quarantined first and then detained”; (see also attached photo)


Third, a foreman in a certain place climbed a tower crane to demand salary and was detained for "malicious demand for salary".


Malicious compensation, malicious return to hometown, and malicious salary begging are three things that have nothing to do with each other, but they are all labeled as "malicious".


So some Chinese netizens jokingly called "malicious" the word of the year.


More netizens posted the book "Malicious" by the Japanese writer Keigo Higashino, and some people bought it to read it. For a while, "malicious" became a hot word on the Internet.


For these "malicious", it is worth seeing how malicious it is


Compensation, returning home, and asking for wages are all objective facts; while malicious intent is "bad intentions, bad intentions" ("Modern Chinese Dictionary"), which are subjective motives.


Logic is about appealing to facts, not to subjective motives.


For example, in the case of Canon Zhuhai factory paying severance pay to employees, we only need to see whether it complies with the "Labor Contract Law of the People's Republic of China".


This is the only standard.


As for the "maliciousness" of subjective motives, it is not the criterion for investigation.


At that time, the company was forced to close because of the policy, and the good luck of these laws can come easily.


Article 47 of the "Labor Contract Law of the People's Republic of China": Economic compensation shall be paid to the laborer according to the number of years the laborer has worked in the unit, and the standard of one month's salary for each full year. If it is more than six months but less than one year, it will be calculated as one year; if it is less than six months, economic compensation of half a month's wages shall be paid to the laborer.


So, how did the Canon Zhuhai factory do it?


Its compensation list consists of five items:

They are economic compensation N+1+1;

Special condolence award;

employment assistance;

Remembrance Award;

Spring Festival condolences (travel expenses for visiting relatives, Spring Festival red envelopes). (see pink with circle)


That is to say, for the 1,317 Chinese employees who were dismissed from Canon Zhuhai, only the first item has fully met the requirements of the "Labor Contract Law", and the last four items have exceeded the legal requirements.


These compensations beyond the legal provisions are a good thing for the dismissed employees, and what is malicious?


If you insist on investigating the "malicious compensation" of the Canon Zhuhai factory, because the malicious intent belongs to the bad intentions and bad intentions of the person in charge of the factory, how do you know it?


Let's look at "Malicious Homecoming".


It is an ancient tradition in our country to return home for the New Year. Those who go out to work take advantage of the rare Spring Festival holiday to return to their hometown to reunite with their relatives and enjoy family happiness, basically looking forward to the big event in the next year.


When opening a company in the mainland, the mean boss will make it easier for employees to go home in terms of administration, payment arrangements, and convenience.


Preventing classmates from returning to the countryside for Chinese New Year is the same crime as murdering their parents.


Could it be that the county magistrate Dong will not be reunited with his family during the Spring Festival?


What's so incomprehensible about this? Instead of being stigmatized as "malicious"? As for what he said at the press conference, I heard that 6 people in high-risk areas said they would return after being shot.


First of all, it's just "heard", and secondly, "I will come back after being shot" is just an angry statement. As a local official, you must first rule the county according to the law, and you cannot threaten to implement "detention" just because of an angry word from a villager. What is the legal basis for your detention?


Of course, it is the most truthful, and more or less reflects the thinking mode of the local crown in the mainland.


As for "malicious wage demands", if the company does not owe wages, and like Canon's Zhuhai factory, it is grateful to its employees and settles salaries in a timely manner, there will be no wage demands, let alone "maliciousness".


In short, malicious compensation, malicious return to hometown, and malicious salary demands are all ignoring the facts, and resorting to subjective motives is logically untenable.


Of course, this can also be reflected in a way of thinking, as long as you are unhappy, without any real evidence, without considering factual evidence, just adding "maliciousness", you can expand public power indefinitely.


Any official may use malice or ulterior motives to describe any person or thing that is not pleasing to the eye, such as malicious non-marriage, malicious infertility, malicious writing poetry, malicious thinking, malicious efforts to work overtime, malicious leave, malicious praise, malicious courtship, malicious show-off , malicious sharing, malicious price reduction, malicious questioning, malicious negotiation, malicious reunion, malicious saving animal life, malicious unity......


Because, in a country full of malice, everything can be "malicious".


This kind of situation, everyone is starting to feel it.
