Hunter ≠ Sinner|Civil Action Newsletter Issue 180
August 1st is "Indigenous Peoples Day". To commemorate the Taiwanese government finally renamed "Mountain Compatriots" as "Indigenous Peoples". Are indigenous peoples really treated with full respect and kindness over the years?
Aboriginal people have recently represented Taiwan in the Tokyo Olympics and have won many successes. The aboriginal peoples, who were “called for identity” by the Han society, were actually faced with many difficulties. Issues such as the right to name the “single family name” and the land rights infringed by the mines and photovoltaic power plants were rarely addressed.
On August 1, 2016, President Tsai Ing-wen apologized to Taiwan's aborigines, hoping to promote multiculturalism in Taiwan's society. However, for many years, the "cultural rights of indigenous peoples to hunt" has been an unresolved issue. It was not until May of this year that the justices finally proposed the Judicial Yuan Interpretation No. 803 for the hunting case of the Bunun hunter Talum Suqluman (Wang Guanglu) and other indigenous peoples.
This issue of the Gongku e-Newsletter will take you back to the issue of "the right of the indigenous hunting culture". Let's start from the Wang Guanglu case and discuss in detail what has been the discussion about "hunters ≠ sinners" over the years? Indigenous peoples are ethnic groups that have their own culture, context, language, social network, etc., and live in this land like you and me. Like everyone on this island, they work hard for life and work hard for cultural heritage. But what constraints and shocks did the legal thinking of Han society bring to them? Apart from the presidential apology and amnesty, what else can Taiwanese society do to achieve "progress" that respects multiculturalism?
